1. ACCEPTANCE OF TERMS

Welcome to Herphangout.com. Herphangout provides you with services that are subject to the following Terms of Service ("Tos"). The Tos may be updated without notice to you. You can make sure and review the most updated Tos at http://www.herphangout.com/tos.php. Note that when you use different services within our site there may be certain guidlines or rules posted.

2. DESCRIPTION OF SERVICE

Herphangout currently provides you with several different resources inlcuding but not limited to:

Chat, forums, personalized content and information regarding to reptiles.
You understand and agree that the Service is provided "AS-IS" and that Herphangout assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

You are responsible for obtaining access to the Service and that access may involve third party fees (such as Internet service provider or airtime charges). You are responsible for all such fees including fees associated with advertisments.

3. YOUR REGISTRATION OBLIGATIONS

You agree that the data you input into the registration form (a) is true, accurate, current and complete and (b) will be updated to keep it true, accurate, current and complete. If any of the data is untrue, inaccurate, not current, or incomplete, Herphangout has the right to cancel your account and refuse future service to you.

Here at Herphangout we are concerned for the privacy as well as the safety of all our users. We are especially concerned about children. Therefore children who are under the age of 13 and wish to create a account must have there parents create the account. When the parent creates the account, they are certifing that they are at least 18 years old and
are the childs legal guardian. By allowing a child to use your account, you are also allowing that child permission to all of the services offered by herphangout, including but not limited to, forums, personalized content and information regarding reptiles. It is your responsibility, as the childs legal guardian, to determine which of the services are appropriate for your child.

5. MEMBER ACCOUNT, PASSWORD AND SECURITY

Upon completing our registration process you will recieve a username and password ("account"). You are responsible for the account including all the activities that occur with this account. You agree that you will (a) immediately notify Herphangout of any unauthorized use of your account and (b) you will exit from your account at the end of your session.

Herphangout cannot and will not be liable for any loss or damaga arising from your failure to comply with Part 5.

6. MEMBER CONDUCT

You, not Herphangout, are entirely responsible for all Content that you upload, post, transmit or otherwise make available via the Service. You agree that all the Content that you make available is your own work and that it is not copywrited and does not belong to any other individual. You also agree that all of the Content you make available may
not be offensive or indecent. However, some individuals make break the Tos and we not be held responsible for any material that is considered indecent, offensive or objectionable. Herphangout will not be held responsible for any loss or damage of any kind as the result of the use of any Content that is made available.

You agree that our Service will not be used to:

1. make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar,
   obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
   
2. harm minors in any way;
   
3. impersonate any person;
   
4. make available any Content that you do not have the right to make available by any law or contract;
   
5. make available any Content that infinges on any patent, trademark, copyright or any other proprietary right;
   
6. make available any Content that is unsolicited or unauthorized advertising;
   
7. make available any Content that will cause harm to any computer hardware or software or any other equipment;
   
8. interfere with Service of any network;
   
9. violate any law;
   
10. harass anyone;
    
11. store or collect personal data about anyone;

You agree that you must evaluate, and bear all risks associated with, the use of any Content.
You acknowledge that you may not rely on any Content created by Herphangout or submitted to Herphangout.
You acknowledge and agree that Herphangout may preserve Content and may also disclose Content if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to:

1. comply with legal process;
   
2. enforce the Tos;
   
3. respond to claims that any Content violates the rights of third-parties;
   
4. protect the rights, property, or personal safety of Herphangout, its users and the public.

7. INDEMNITY

You agree to indemnify and hold Herphangout and anyone associated with us, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you make available through the Service, your use of the Service, your connection to the Service, your violation of the Tos,
or your violation of any rights of another.
